Terms of Service

Courtesy translation. Menustro is a French business and its contractual documents are written in French. This English version is provided for convenience only and has no contractual value. In the event of any discrepancy, only the French version is legally binding.

1. Service publisher

Louis VICAT, sole trader (entreprise individuelle), trading as Menustro, whose registered office is at 63 chemin de Ribotière, 38330 Saint-Ismier (France), registered with the Grenoble trade register under number 107 544 827 R.C.S. Grenoble, SIREN 107 544 827, SIRET (registered office) 107 544 827 00010, VAT not applicable (article 293 B of the French General Tax Code).

Definitions

Menustro means the business operating the service identified above.

Service means all the features available through the Menustro website and dashboard, allowing the creation and management of multilingual digital menus with allergen information, accessible by QR code.

User means any person holding a Menustro business account.

Establishment means a restaurant or food service venue managed through a Menustro account.

Account means the business workspace giving access to the Service’s features.

End customer means any person viewing a digital menu via a QR code, with no account required.

2. Purpose

These Terms of Service set out the conditions for accessing and using the Menustro service available from https://menustro.com and the business dashboard.

They apply to professionals creating and managing an account for an establishment.

3. Acceptance of these Terms

Creating an account or using the service implies full and unreserved acceptance of these Terms of Service.

These Terms are supplemented by the Terms of Sale and the Privacy Policy.

4. Description of the service

Menustro allows restaurant operators to create, update and publish multilingual digital menus, including the regulatory allergen information, accessible to end customers via a QR code. The service is currently available through a web dashboard; a mobile application is planned for a later date.

At present, a Menustro account is attached to a single establishment.

Menu translation. To produce the multilingual versions of the menu, the item names and descriptions entered by the restaurateur are sent to a third-party translation provider. No personal data — neither the restaurateur’s nor their guests’ — is sent in the process: only the menu texts travel, and those are already public since they are served to anyone scanning the QR code.

5. User account

The user undertakes to provide accurate, complete and up-to-date information, in particular regarding their establishment and the content of their menus. They are responsible for keeping their credentials confidential and for the actions carried out from their account.

The user may sign in by email and password, via Google, or via Apple (Sign in with Apple).

In the event of loss of control of the account or unauthorised access, the user must contact Menustro without delay.

6. Rules of use

The user shall refrain from any fraudulent, unlawful or misleading use, and from any use that infringes third-party rights, the security of the service or its proper operation.

The user is solely responsible for the accuracy of the information published on their menus, in particular the allergens declared, and warrants that it complies with the applicable regulations.

7. Menustro’s role

Menustro provides a technical tool for creating and publishing digital menus. The establishment remains solely responsible for the content of its menus, for their accuracy, and for compliance with its regulatory obligations (in particular regarding allergen information).

Machine translations. The restaurateur designates the language in which their menu is written. Versions in other languages are produced automatically by a translation tool and constitute a comprehension aid, not a certified translation.

Only the version written by the restaurateur, in the language they designated, is legally binding. That version is the one stored, the one printed on the preparation ticket sent to the kitchen, and the one displayed to the guest alongside the translation, whatever language is being viewed. Where that version and a translation diverge, the former prevails.

The restaurateur can review, correct and replace every translation from their dashboard. A translation corrected in this way is no longer modified automatically. It is their responsibility to check the translations of the languages they enable, as they check the rest of their menu content.

Allergen labels are not machine-translated. The fourteen allergens subject to mandatory declaration under Regulation (EU) No 1169/2011 are displayed from a fixed terminology, established language by language and built into the service. They never pass through any machine translation tool. Identifying which allergens are present in each dish nevertheless remains the sole responsibility of the establishment.

8. Intellectual property

Elements belonging to Menustro. The Menustro platform (code, interfaces, databases and graphic elements) is protected by intellectual property rights and remains the exclusive property of Louis VICAT or his assigns.

The name “Menustro”, its logo and its visual identity are protected distinctive signs. Any reproduction, imitation, adaptation or use of those signs, in whole or in part, modified or not, on any medium whatsoever, is prohibited without prior written authorisation. This prohibition covers in particular extracting the logo from the service’s pages or from a public menu.

Any reproduction, reverse engineering or creation of a competing service from Menustro’s elements is likewise prohibited.

Extraction of public menus. The menus published through the service constitute a database of which Louis VICAT is the producer. Repeated extraction and re-utilisation, or extraction and re-utilisation of a substantial part of their contents — assessed qualitatively or quantitatively — are prohibited under articles L342-1 et seq. of the French Intellectual Property Code. This covers in particular automated collection by any means.

Restaurateur’s content. The restaurateur remains the owner of the content they publish — logo, photographs, menu item names and descriptions. Menustro claims no ownership over that content.

The restaurateur warrants that they hold the necessary rights over the material they upload and that it infringes no third-party rights. They grant Menustro, for the term of their contract only and solely for the purpose of operating the service, a non-exclusive, royalty-free licence to display, technically reproduce and adapt the format of that content, including translating their menu and resizing their images.

9. Service availability

Menustro uses reasonable means to ensure the availability and security of the service, without guaranteeing the absence of interruption, slowdown or error.

10. Suspension, deactivation and deletion of the account

Menustro may suspend or restrict access to the service in the event of fraudulent use, breach of contract or security breach.

The user may request deletion of their account from their dashboard. The account is then deactivated immediately and retained for 30 days, during which reactivation remains possible by signing in again. After that period, personal data and the establishment’s content are deleted or anonymised; invoices are retained for 10 years (accounting obligations). 11. Liability

Menustro is bound by an obligation of means (obligation de moyens). It cannot be held liable for malfunctions relating to networks, Internet infrastructure, third-party services, or non-compliant use of the service.

14. Changes to these Terms

Menustro may update these Terms of Service at any time. The version in force is the one published on this page as at its update date.

15. Governing law and jurisdiction

These Terms of Service are governed by French law. Any dispute falls within the exclusive jurisdiction of the Commercial Court having jurisdiction over Menustro’s registered office (Grenoble), subject to any mandatory rules applicable to consumers where relevant.

16. Language of the contract

These Terms of Service are written in French. Any translation into another language is provided for information only and has no contractual value. In the event of any discrepancy between the French version and a translation, only the French version is legally binding.
